Terms of Service
Version 0.5 — CVR + VAT + registered address filled in · Last updated 2026-05-14
⚠️ This is a working draft. It has not been reviewed by a lawyer. Do not publish externally without that review.
1. Agreement
These Terms of Service ("Terms") are an agreement between you and Næxt AI (the "Service Provider", "we", "us") for use of AI Stream Jobs (the "Service").
By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. Eligibility
You must be at least 16 years old (and the legal age of digital consent in your country, whichever is higher) to use the Service. By signing up you confirm that.
The Service is for individual job seekers tailoring their own CV. You may not use it on behalf of others, resell drafts, or use it for bulk submission of applications you didn't personally evaluate.
3. Your account
- You're responsible for the accuracy of information in your account.
- You're responsible for keeping your sign-in credentials secure.
- You may not share your account.
- We may suspend or terminate your account if you violate these Terms (see §10 Termination).
4. Plans, billing, and refunds
- We offer one free Trial tier and several paid plans, summarized in
Settings → Plans & pricing. - Plans are billed monthly or quarterly. Quarterly billing is charged upfront for three months and may be discounted (currently 20%); the discount can change for new sign-ups but won't change for an active billing cycle.
- The draft cap resets monthly regardless of billing cadence.
- Merchant of Record: payments for AI Stream Jobs are processed by Paddle.com Market Limited ("Paddle"), our payment processor and Merchant of Record. This means Paddle is the seller of record for your subscription, and Paddle handles billing, payment-method storage, sales-tax/VAT collection and remittance, refunds, and chargebacks on our behalf. The transaction on your card or bank statement will reference Paddle. Paddle's own customer terms apply to the transaction in addition to these Terms.
- Refunds: we don't offer refunds for partial usage. Detailed refund eligibility and the EU 14-day right of withdrawal are covered in our Refund Policy. If you cancel a quarterly plan after 1 month, you keep access through the end of the prepaid period.
- Disputes: if you believe a charge is wrong, contact us first (§11 Contact) before filing a chargeback. We can usually resolve legitimate billing errors within 7 days, which is faster than the chargeback process and avoids fees on both sides. Where we cannot resolve it, you may also raise the issue directly with Paddle as the seller of record.
- We may change pricing for new sign-ups at any time. If we change pricing for your existing plan, we'll notify you at least 30 days before the change takes effect.
5. The AI part
AI Stream Jobs uses third-party AI providers (Anthropic and Google) to generate tailored CVs and cover letters from your input. By using the Service:
- You consent to your CV text and the job description being sent to those providers solely for the purpose of generating drafts. Both providers' commercial terms forbid them from training models on this traffic.
- The AI output is a draft, not a finished document. You're responsible for reviewing it before submitting it to an employer.
- We don't guarantee that AI output is factually correct, legally appropriate, free of bias, or that it will help you get an interview.
- You retain full ownership of:
- the input you provide (your CV, cover letter samples)
- the output the AI generates (the tailored draft)
- any edits you make
- You grant us a limited license to process this content solely to operate the Service.
6. Acceptable use
You may not:
- Misrepresent yourself in your CV or cover letter (including using the Service to generate fictional credentials)
- Use the Service to spam-apply to jobs without reading them
- Reverse-engineer, scrape, or attempt to extract our prompts or model behavior
- Use the Service to generate content that's illegal, harassing, or designed to harm someone
- Bypass usage caps, billing, or rate limits via multiple accounts or other tricks
- Use the Service for any purpose other than your own job search
We can suspend accounts that violate this section without prior notice, especially for fraud or abuse.
7. Intellectual property
- Your content stays yours. We don't claim any ownership over your CV, cover letter, or tailored drafts.
- Our software stays ours. The AI Stream Jobs app, code, prompts, and templates are our intellectual property; you don't get a license to copy or redistribute them.
- Trademarks — "AI Stream Jobs" and the logo are ours. Don't use them to imply endorsement.
8. Privacy and data
How we handle your personal data is described in our Privacy Policy, which is incorporated by reference into these Terms.
You may delete your account at any time from Settings → Danger zone. Deletion is permanent and includes everything in our Firestore database. Backups expire within 30 days.
8.1 EU users — sign-in identity exception
If you sign up with your region set to "Europe / EEA" in Settings → Profile, your CV content, drafts, applications, settings, and AI model calls stay in Google Cloud's europe-west1 region. One exception: your sign-in identity (email address and display name) is processed by Google Firebase Authentication in the United States. As of 2026, Firebase Authentication does not offer EU data residency.
This transfer of your sign-in identity is covered by Standard Contractual Clauses (SCCs) approved by the European Commission and (where applicable) by the EU–US Data Privacy Framework. We rely on the legal basis of "performance of a contract" (GDPR Article 6(1)(b)) for this transfer because we cannot operate the Service without storing your authentication identity.
The in-product consent dialog asks you to explicitly acknowledge this exception via a separate checkbox before you create an account. If you do not accept it, we cannot create your account. We will revisit this exception when Firebase Authentication ships full EU data residency, or when our EU customer base requires us to migrate to an EU-resident authentication provider — whichever comes first. The full breakdown of which data lives where is in Privacy Policy §6.1.
9. Service availability
We try to keep the Service running 24/7 but we don't promise specific uptime. Maintenance, outages, and force-majeure events happen.
If we have to take the Service offline for an extended period (>7 days), we'll prorate any active paid plan.
10. Termination
You can terminate by deleting your account.
We can terminate or suspend your account if:
- You violate these Terms (especially §6 Acceptable use)
- Your payment fails and isn't resolved within 14 days
- We're required to by law
- We're shutting down the Service (we'll give 30 days notice and a way to export your data)
On termination: your access stops, your data is deleted within 30 days, any outstanding balance is settled.
11. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the maximum extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for:
- Lost job opportunities, offers, or interviews
- AI output that's incorrect, biased, or inappropriate
- Indirect, consequential, special, or punitive damages
- Loss of data due to your own actions (e.g. clearing localStorage before exporting)
- Outages caused by our vendors (Anthropic, Google, Stripe)
If a court finds us liable despite the above, our total liability is capped at the greater of: (a) what you paid us in the 12 months before the claim, or (b) USD $100.
These limits don't apply where they're forbidden by law (some EU jurisdictions limit liability waivers — those laws prevail).
12. Indemnification
You'll defend, indemnify, and hold us harmless from third-party claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any law.
13. Governing law and disputes
These Terms are governed by the laws of (jurisdiction TBD before publication — likely the country/state where the Service Provider is registered).
Disputes go to the courts of that jurisdiction.
EU users: nothing here strips you of mandatory rights you have under EU consumer law.
14. Changes to these Terms
We can update these Terms. For material changes, we'll email you at least 30 days before the new version takes effect. If you keep using the Service after that date, you've accepted the new Terms. If you don't agree, terminate per §10.
15. Contact

16. Change log
| Version | Date | Notes |
|---|---|---|
| 0.1 | 2026-05-01 | First internal draft. Not yet published. |
| 0.2 | 2026-05-04 | Phase 7.6 — added §8.1 EU-users sign-in identity exception, mirroring Privacy Policy §6.1. Documents the Firebase Auth US-residency exception with the same legal basis (Article 6(1)(b) + SCCs). No other section changed. |
| 0.4 | 2026-05-09 | §15 contact email filled in (support@aistreamjobs.com). §1 service provider updated from "Marcelo Bertalan" to "Næxt AI" (legal entity now exists). (Note: header was already at 0.3 for the Paddle MoR change without a corresponding changelog entry — pre-existing drift, not addressed here.) |
| 0.5 | 2026-05-14 | §15 expanded with the legal-entity facts now that Næxt AI is registered (CVR 46456556, VAT DK46456556, Vesterbrogade 81, 5. tv., 1620 København V, Denmark). Identifies "Næxt AI" as a trading name of Marcelo Bertalan Quintanilha dos Santos under Danish sole-proprietorship (Enkeltmandsvirksomhed) — the legal service provider is the natural person, not a separate legal entity. Substantive review still pending lawyer pass. |
